1. Acceptance of Terms

Welcome to ScriptGraph. These Terms of Service ("Terms") govern your access to and use of the ScriptGraph website, products, and services (the "Service") operated by ScriptGraph ("we", "us", or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

2. Description of Service

ScriptGraph is a web-based scriptwriting tool for content creators. It helps creators write, structure, and iterate on video scripts using AI-assisted generation and a visual node-based editor. Users can organise scripts by section, generate multiple variations, and refine their content to improve audience retention and video performance.

We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

3. User Accounts

To access certain features of the Service, you must register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your account information
  • Maintain the security of your password and accept all risks of unauthorized access
  • Notify us immediately if you discover any security breach

Age Requirement: You must be at least 18 years old to use this Service. By creating an account, you confirm that you are 18 years of age or older.

Account Sharing: You may not share your account credentials with others or allow others to access your account.

Account Deletion: You may delete your account at any time through the Account Settings page. Upon deletion, your personal data will be removed from our systems within 30 days in accordance with our Privacy Policy.

4. Prohibited Uses

You agree not to use the Service to:

  • Engage in any illegal activities
  • Post harmful or dangerous content
  • Send spam or unsolicited communications
  • Infringe on intellectual property rights
  • Upload, submit, or use copyrighted material as AI context or input without appropriate rights or authorisation to do so
  • Harass, bully, or threaten others
  • Post violent content or threats
  • Use automated systems to scrape data
  • Distribute malware or viruses
  • Post explicit or adult content
  • Post hate speech or discriminatory content
  • Use AI-assisted features to generate content intended to deceive, manipulate, or harm others

Violation of these rules may result in immediate termination of your account.

5. Payment Terms

Free Tier

ScriptGraph offers a free tier that includes access to manual mode and a limited allocation of AI credits. We reserve the right to modify, reduce, or remove the free tier and its associated credits at any time at our sole discretion. Free tier credits have no cash value and are non-transferable.

Signup credits are granted only once, at the time an account is first created. If you later upgrade to a paid subscription and subsequently downgrade or return to the free tier, any remaining signup credits at the time of downgrade may be forfeited and will not be re-granted. Signup credits are not re-issued on any plan change, re-subscription, or account restoration.

Paid Subscriptions

Premium features require a paid subscription. Subscription pricing and available tiers are listed on our pricing page. By subscribing, you agree to the following:

  • Subscriptions are billed on a recurring basis (monthly or annually depending on the plan selected)
  • You authorise us to charge your payment method on each billing cycle
  • You may cancel your subscription at any time through your account settings
  • Upon cancellation, you will retain access to paid features until the end of your current billing period
  • We do not provide prorated refunds for unused time within a billing period

AI Credits

Paid subscriptions include an allocation of AI credits per billing cycle. The following conditions apply:

  • Unused AI credits do not roll over to the next billing cycle
  • Any AI credits included as part of a paid subscription are forfeited upon cancellation, downgrade, non-payment, or expiry of that subscription, and will not be transferred to any other plan or tier
  • AI credits have no cash value and are non-refundable
  • We reserve the right to adjust credit allocations across plans at any time at our sole discretion

Price Changes

We reserve the right to modify subscription pricing at any time. For existing subscribers, we will provide at least 30 days' notice of any price change via email to the address associated with your account. Your continued use of the Service after the price change takes effect constitutes your acceptance of the new price. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.

Refund Policy

All payments are generally non-refundable. However, we offer a 7-day money-back guarantee on your first payment only, provided that you have not used any AI credits on your account during that period. To request a refund under this guarantee, contact us at support@scriptgraph.io within 7 days of your first charge.

Nothing in this refund policy limits any rights you may have under applicable consumer protection laws, including the Australian Consumer Law.

6. AI-Generated Content

ScriptGraph uses third-party AI services (including Anthropic and OpenAI) to generate script content based on your inputs. By using AI-assisted features, you acknowledge and agree to the following:

  • AI-generated content is provided as a starting point and may be inaccurate, incomplete, or unsuitable for your specific needs
  • You are solely responsible for reviewing, editing, and fact-checking any AI-generated content before publishing or using it
  • We make no warranties regarding the originality, accuracy, or fitness for purpose of AI-generated outputs
  • You must not use AI-assisted features to generate content that violates any applicable laws or these Terms
  • We are not liable for any claims arising from your use or publication of AI-generated content, including claims of copyright infringement or defamation

7. Intellectual Property

The Service and its original content, features, and functionality are owned by ScriptGraph and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Content you create using the Service remains your property. You grant us a limited licence to store and process your content solely for the purpose of providing the Service to you.

Ownership of AI-generated content is subject to applicable laws in your jurisdiction. We make no claim of ownership over content generated through the Service. You are responsible for determining the intellectual property status of any AI-generated content before publishing or commercialising it.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ScriptGraph.

8. Content and Results Disclaimer

ScriptGraph is a tool to assist with content creation. By using the Service, you acknowledge and agree to the following:

  • We make no guarantees regarding the impact of any content created using the Service on video performance, audience retention, views, subscriber growth, or any other metric
  • Results will vary based on factors entirely outside our control, including but not limited to platform algorithms, audience behaviour, content quality, and market conditions
  • You are solely responsible for all scripts, outlines, and other content you create, publish, or distribute using the Service, whether generated manually or with AI assistance
  • We accept no liability for any outcomes, losses, or damages arising from content you create or publish using the Service
  • We do not review, endorse, or take responsibility for any content created by users of the Service

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

ScriptGraph does not warrant that the Service will function uninterrupted, secure, or available at any particular time or location, or that any errors or defects will be corrected.

10. Limitation of Liability

In no event shall ScriptGraph, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content
  • Any AI-generated content produced through the Service

11. Indemnification

You agree to defend, indemnify, and hold harmless ScriptGraph and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including any claims arising from content you generate or publish using the Service.

12. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. You may delete your account at any time through your Account Settings page.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions.

Mediation: Before initiating any legal action, both parties agree to attempt to resolve disputes through good-faith mediation.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
